The Enugu State high court has ordered the Independent Corrupt Practices and other related Offences Commission ICPC to release investigative report against the immediate past Solicitor General of Enugu, Barr. Victor Emeribe over alleged criminal complexity.
Justice A.O. Onovo issued the order following a Motion on Notice in suit No E/281/2016 filed by Chief Dr. Gerald Abonyi, counsel to the Plaintiff/Applicant Chief Agbo Anike Stanislaw to compel the ICPC to release their findings in furtherance to the subpoena already Issued to the Commission.
Chief Agbo Anike Stanislaw had in 2017 petitioned the ICPC against a former solicitor General of Enugu State – Barrister Victor .C . Emeribe for allegedly doctoring, forging and uttering a deed of legal mortgage and allegedly transferring same as power of Attorney purportedly issued by the plaintiff ( Cheif Agbo Anike Stanislaw.
Chief Agbo among other things alleged that the former Solicitor General Barrister Victor Emeribe in collaboration with one Chief Virginus Nnaji fraudulently claim ownership of his house at plot 246b Independence Layout Enugu. among other malfeasance.
The ICPC is alleged to have concluded investigation on the allegations levelled against the defendant (Former solicitor general Barrister Victor Emeribe) but has not disclosed its findings close to nine years thereafter.
The court found favour in the argument adduced by the plaintiff and ordered for unconditional release of the investigation.
It is expected that the report if released would serve as a material fact to proving criminal complexity against the defendant who retired/resigned last year from the service.
The matter was adjourned to 23rd of this month for continuation of hearing.
